7.1 AguAqui sells products such as:
- water;
- beverages;
- milk and dairy products;
- coffee;
- snacks and food products;
- household stationery items;
- home accessories and equipment.
7.2 These products are intended for final consumption. Once opened, they are not eligible for return, except in cases of defect or delivery error. Unopened products may be returned under the right of withdrawal (section 8 and the Return Policy).
8. Right of Withdrawal
8.1 The customer may exercise the right of withdrawal within the legal period of 14 days, except in legally excluded cases.
8.2 The following are not eligible for return:
- perishable products or products that may deteriorate rapidly;

- sealed products after the packaging has been opened.
8.3 Non-food equipment sold online may be returned within the legal 14-day period, complete and with its packaging and accessories, in accordance with the Return Policy. The customer is responsible for any loss of value resulting from handling beyond what is necessary to check the product.
9. Reusable Water Bottles
9.1 The 18.9L reusable water bottles remain the exclusive property of MPS ÁGUA, LDA.
9.2 The customer undertakes to:
- keep the bottles in good condition;
- not damage them;
- not sell or transfer them to third parties;
- return them whenever requested or during future deliveries.
9.3 In case of loss, misplacement or non-return, a fee of €10 per bottle will be charged.
10. Equipment and Accessories
10.1 Equipment sold or provided by AguAqui must be used properly.
10.2 In case of sale, the equipment becomes the property of the customer.
10.3 In the case of equipment provided under subscription plans: the equipment must be returned at the end of the subscription; after inspection, breakdowns not caused by the customer are repaired free of charge; in case of damage caused by misuse, a fee of €100 per dispenser applies (section 11.5).
11. Water Subscription with Dispenser
11.1 AguAqui offers a monthly water subscription: 2, 3 or 4 reusable 18.9 L bottles delivered every month, with a water dispenser lent free of charge and free delivery, installation and technical support. The plan, the price and the first delivery are shown at checkout and in the Water Subscription Contract accepted by the customer. If these Terms and the contract differ, the contract prevails.
11.2 The subscription is paid by card. The first payment is made at checkout; after that, the monthly amount is charged automatically to the same card before each delivery. If a payment fails, the delivery does not take place until the amount is paid.
11.3 Deliveries are monthly, on the agreed date and time slot. The customer may ask to move a delivery up to 3 days earlier or later than planned, subject to confirmation. If the customer is not present, the bottles are left at the door when this is possible and safe; otherwise, AguAqui informs the customer and waits for the customer to get in touch, and delivers on the next working day after that contact. Delivery dates and times are estimates; a delay does not entitle the customer to compensation or to terminate the contract, without prejudice to consumers’ statutory rights. The customer may pause deliveries for 1 to 3 months in the customer area; for each paused month only a dispenser fee of €9.90 is charged (the first one when the pause is confirmed, the following ones by payment link), and deliveries can be resumed at any time. A new pause can only be started after at least one delivery following the previous pause; deliveries cannot be paused once a cancellation has been requested, and cancelling during a pause ends the pause.
11.4 The customer may change plan at any time in the customer area; the new plan and price apply from the next payment that has not yet been taken. On the Pro plan, extra bottles can be added to the monthly delivery for €4.50 each. Extra orders between deliveries cost €7.89 per bottle, with a minimum of 2 bottles.
11.5 The dispenser remains the property of MPS ÁGUA, LDA. If the dispenser stops working, AguAqui inspects it; breakdowns not caused by the customer are repaired, or the dispenser is replaced, free of charge. Damage or breakdowns caused by misuse are charged at €100 (section 10.3). The dispenser and the bottles are returned at the end of the subscription. A professional cleaning and sanitising of the dispenser can be ordered for €23. The bottles are the property of MPS ÁGUA, LDA, with no deposit; they must be kept in good condition, with no other liquids or objects inside, and must not be lost or given to third parties. Full bottles are not taken back at the end of the subscription. A lost, damaged, unreturned or resold bottle is charged at €10.
11.6 The subscription has no minimum term. The customer may cancel at any time, in the customer area or through customer support, with at least 30 days’ notice, counted from the date the request is sent.
11.7 The subscription ends on the first payment date after the notice period ends; until then, payments and deliveries continue as usual. Cancelling is free of charge, and AguAqui collects the dispenser and bottles at no cost.
11.8 AguAqui may change the price with at least 30 days’ notice; the customer may cancel before the new price applies, without the 30 days’ notice.
11.9 If two consecutive monthly payments are not made, AguAqui may end the subscription and collect the dispenser and the bottles; only the amounts due are payable. In case of a serious breach, AguAqui may end the subscription immediately.
11.10 Consumers may withdraw within 14 days of the first delivery (section 8 and the Return Policy), without the 30 days’ notice.
11.11 Business customers may have specific conditions set out in a separate contract.
12. Customer Responsibility
The customer undertakes to:
- provide accurate data;
- ensure access to the delivery location;
- use products and equipment correctly;
- not use the products improperly or for unauthorized commercial purposes.
13. Limitation of Liability
AguAqui shall not be liable for:
- delays caused by external factors;
- misuse of the products;
- indirect damages or loss of profit;
- inability to deliver due to safety or access reasons.
Nothing in these Terms limits the consumer's statutory rights under Portuguese and European law.
14. Cancellations
14.1 Orders may be cancelled before they are dispatched.
14.2 After dispatch or once the order is out for delivery, cancellations are not accepted.
14.3 If a paid order is cancelled by the customer before dispatch, or by AguAqui (e.g. product unavailable or delivery impossible), the amount paid will be refunded using the same payment method within 14 days.
15. Amendments
AguAqui may update these Terms at any time. The most recent version is always published on the website. Each order is governed by the version in force at the time the order was placed.
